NBA Investigation of Jay-Z’s UK Locker-room Visit: Importance of High-Profile Due-Diligence Programs

The Guardian newspaper reported entertainment mogul Jay-Z’s post-game visit to the University of Kentucky men’s basketball team’s locker-room last week has garnered attention from the National Basketball Association (NBA). As part-owner of the NBA New Jersey Nets franchise, Jay-Z is prohibited from having any contact with student-athletes who have not declared themselves eligible for the NBA draft. Thus, Jay-Z broke the rules since Kentucky’s basketball season is not complete and none of the student-athletes on the team have declared for the NBA draft. Further, the Jay-Z locker-room incident is another reminder for NCAA member institutions for why a high-profile student-athlete due-diligence program is important. A due-diligence program is used to ensure high-profile student-athletes (as well as the athletes’ parents, guardians and other associated individuals) comply with NCAA legislation. One element of a comprehensive due-diligence program is the monitoring of (and limiting access to) the following areas: a) athletics facilities (including locker-rooms and practice areas); b) sidelines or other limited-access areas during athletics contests; and c) team-chartered transportation.
