Regional NLRB Rules Northwestern Football Student-Athletes Qualify as Employees

The Chicago district of the National Labor Relations Board (NLRB) ruled on Wednesday, March 26, 2014, that Northwestern University football student-athletes qualify as employees of the university and can unionize. NLRB regional director Peter Sung Ohr noted the student-athletes’ time commitment to the sport and the student-athletes’ athletics scholarships were tied directly to their performance on the field as reasons for granting them union rights. Northwestern stated it will appeal to the full NLRB in Washington, D.C. The highly contested union issue will likely head to a federal court thereafter—with a possible day before the United States Supreme Court.
